Terms of Service

All sales are final. By using this website, submitting an inquiry, remitting a deposit, or purchasing any artwork, print, or commission, you agree to these Terms. If you do not agree, do not use the site or transact with the studio.
These Terms of Service govern your use of mikamayfield.com (the “Site”) and any transaction with Michaella Bosumbafo Mayfield doing business as Mika Mayfield (the “Studio” or “we”). By using the Site or transacting with the Studio, you accept these Terms in full.
The Site is a portfolio and inquiry channel. It is not a checkout or e-commerce storefront. Prices, availability, and specifications shown on the Site are informational only and may change without notice. Nothing on the Site constitutes a binding offer to sell.
Submitting the inquiry form does not create a contract, reserve a piece, or oblige the Studio to sell or accept a commission. A binding contract is formed only when: (a) the Studio confirms availability and terms in writing, (b) a written agreement is accepted by both parties (for commissions), and (c) the required deposit has cleared.
No refunds are offered under any circumstance, including but not limited to: change of mind, delayed delivery within the estimated timeline, dissatisfaction with the artistic interpretation, client-caused delays, or third-party carrier issues. Deposits, balances, print purchases, licensing fees, and commission fees are non-refundable once paid.
If the Studio is unable to complete a commission for reasons within its control, the Studio may, at its sole discretion, offer a credit toward a different piece or a print of comparable value. This remedy is discretionary and does not create an entitlement to a cash refund.
All delivery dates, turnaround windows, and schedules communicated by the Studio are estimates only. The Studio is not liable for consequential, incidental, or special damages arising from delays — including, without limitation, missed gifting occasions, missed events, or emotional distress.
All artwork, sketches, studies, files, and content on the Site are the exclusive property of the artist. Copyright is retained by the artist unless a signed written agreement expressly transfers specific rights.
Purchase of a print, original, or commissioned piece grants you a personal, non-transferable, non-commercial display license. You may not:

By submitting reference photos, text, or other material to the Studio, you warrant that you own or have the right to submit that material and grant the Studio a non-exclusive license to use it solely for the purpose of completing the commissioned work.
Physical items are shipped at the buyer's expense using a trackable carrier. Risk of loss passes to the buyer once the item is handed to the carrier. The Studio is not liable for lost, delayed, or damaged shipments beyond the good-faith remedies described in the Policies.
The Site and all artwork are provided “as is” and “as available.” To the maximum extent permitted by law, the Studio disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. The Studio does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by law, the Studio's total liability arising out of or relating to any transaction — whether in contract, tort, or otherwise — shall not exceed the amount actually paid by you to the Studio for the specific piece or commission at issue. The Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
You agree to indemnify and hold harmless the Studio and its representatives from any claims, damages, or expenses arising from (a) your breach of these Terms, (b) your misuse of any artwork, or (c) any reference material or content you submit that infringes the rights of a third party.
The Site and Studio operations rely on third-party services (including but not limited to Stripe, Netlify, email providers, and shipping carriers). The Studio is not responsible for the acts, omissions, availability, or terms of those third parties.
The Studio may update these Terms at any time. The “Effective” date at the top of this page reflects the current version. Continued use of the Site or continued transactions after an update means you accept the updated Terms.
These Terms are governed by the laws of the United States of America, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or any transaction shall be resolved individually, and you waive any right to participate in a class or representative action to the extent permitted by law.
